Group accuses ASCE of wrongdoing in Katrina investigation
A New Orleans-based, grassroots group claimed last week that records it obtained under the Freedom of Information Act show that "as early as October 2005, The U.S. Army Corps of Engineers directed the American Society of Civil Engineers (ASCE) and later paid the group more than $1.1 million for their peer review of the [Interagency Performance Evaluation Taskforce (IPET)] and for giving [PowerPoint] seminars which contained at least 10 falsehoods, four significant omissions, and numerous misrepresentations." The group, Levees.Org—with a stated mission of "education that metro New Orleans was destroyed not by a natural disaster [Hurricane Katrina], but by the worst engineering failure in the world since Chernobyl"—previously called on the ASCE to conduct an ethics investigation into allegations of wrongdoing and collusion with the Corps....

Agencies release new wetlands rule
The U.S. Army Corps of Engineers and U.S. Environmental Protection Agency released a new rule on March 31 to clarify how to provide compensatory mitigation for unavoidable impacts to the nation’s wetlands and streams. The new rule establishes performance standards, sets timeframes for decision making, and to the extent possible, establishes equivalent requirements and standards for the three sources of compensatory mitigation: permittee-responsible mitigation, mitigation banks, and in-lieu-fee programs. The new rule changes where and how mitigation is to be completed, but maintains existing requirements on when mitigation is required. The rule also preserves the requirement for applicants to avoid or minimize impacts to aquatic resources before proposing compensatory mitigation projects to offset permitted impacts....

Study assesses climate change impacts to Gulf Coast transportation infrastructure
The U.S. Department of Transportation (DOT) released a study on the potential impacts of climate changes and land subsidence on transportation infrastructure in the U.S. Gulf Coast region. The Impacts of Climate Change and Variability on Transportation Systems and Infrastructure: Gulf Coast Study, Phase I (phase one of a three-part study), assesses the vulnerabilities of transportation systems in the region to potential changes in weather patterns and related impacts, as well as the effect of natural land subsidence and other environmental factors in the region. The area examined by the study includes 48 contiguous counties in four states, running from Galveston, Texas, to Mobile, Ala....

London’s super sewer to handle CSOs
Thames Water, the United Kingdom’s largest water and wastewater services agency, appointed CH2M HILL as program manager for the Thames Tideway Tunnel to help deliver what’s being called the super-sewer, which is expected to prevent combined sewer overflows (CSOs) in London from entering the River Thames. The project involves construction of London’s deepest-ever tunnel—the Thames Tunnel—as deep as 260 feet beneath ground level and spanning about 20 miles beneath the River Thames from Hammersmith in West London, to Beckton, in East London. An additional tunnel—the 4.3-mile-long Lee Tunnel—will run from Abbey Mills in Stratford to Beckton....

Home Depot pays stormwater fine
Home Depot agreed to pay a $1.3 million penalty and implement a nationwide compliance program to resolve alleged violations of the Clean Water Act, the U.S. Justice Department and U.S. Environmental Protection Agency (EPA) announced in February. The settlement resolves alleged violations that were discovered at more than 30 construction sites in 28 states where new Home Depot stores were being built. The settlement requires that Home Depot implement a comprehensive, corporate-wide program to prevent stormwater pollution at each new store it builds nationwide....
